Should I Secure A Rental Before Filing Bankruptcy

Posted on July 20th, 2011 by Abby Gloucester

When I went to speak to the attorney I told him about the situation and he stated that I had about 3 months that I could live in my current home before it would be foreclosed on. So from my personal experience you do not have to secure a rental before you file for bankruptcy.

If you have talked to some professionals and have found no other option but filing bankruptcy; then I would plan on staying in your home until you are at least 3 months behind. This will give you an opportunity to save some money so that you can move into a new home or into a new apartment.

As for the bankruptcy showing up on the credit report; I personally thought that it was going to hinder my ability to get a new apartment or in some way prevent me moving into a decent part of the neighborhood. However I told the lady at the apartment complex the situation and everything was fine. I was still able to move into the complex without having to pay a ridiculous deposit.

She told me that they do not look at that type of stuff; all they want to know is that you did not bail out on a lease in the past. So if you have been wondering “should I secure a rental before filing bankruptcy” my response would be to stay in your current home for as long as you can so that you can save money to get into a new place.

Of course if you are already defaulted on your loan; then you may not have this option. I would definitely speak to someone who can assist you with all the questions that you have. You can find ways to learn how to clear up all your debt quickly by
